Judge upholds Mosley’s lawsuit against Conte

A New York State Supreme Court justice refused Wednesday to throw out Shane Mosley’s lawsuit against Victor Conte, founder of BALCO.

Mosley is suing Conte for defamation in New York after Conte said Mosley knowingly took performance-enhancing drugs, including EPO.

Conte’s attorney argued that the lawsuit was frivolous.

Mosley admitted he took steroids before his 2003 fight against Oscar De La Hoya but says he didn’t know they were illegal.



“This is one step along the road of securing justice for Shane,” said Judd Burstein, Mosley's lawyer. “Conte can run, but he cannot hide from me.”
